Legal Question in Landlord & Tenant Law in New York

Hi,

My wife and I are tenants in what was supposed to be an upscale building in NYC. We have lived here two years without incident.

However, a couple of weeks ago, some new tenants moved in next door. Since then, the entire floor (and our apartment) stinks of weed. Our bedroom backs onto their lounge, and the smell gets so bad we can't sleep in it.

My husband has escalated to the building property manager who said that the tenents are "a friend of someones in the leasing office". He said there is nothing he can do.

Surely this can't be the case?! He's turning a blind eye to illegal activity - this must be against the Terms and Conditions of the lease.

Please help. We are not sure what options we have? Can we terminate our lease, could they keep our deposit?

If you have a written lease there should be a clause about sending formal notice, probably by certified mail.

I would send a letter under the terms of the lease complaining about the illegal activity. If the letter does not receive a response, I would contact the police.
