Legal Question in Landlord & Tenant Law in New York
My husband and I prepaid our rent from Feb 2011 until Dec 2011. Our lease is
up this month and we are leaving by July 31st. I know in NYS that
they can hold our security deposit 30-60 days. Do you know if they can also
hold our prepaid rent for that amount of time legally? They told us that we
will recieve the security deposit and the extra rent money back the same time-
even though technically its not their money until the first of the month. We paid
after the lease would be up because we figured that we would still be here.
Unfortunately we are not renewing our lease and are worried about when we will
recieve our money back. They have also told us that it depends on the month when
the money will be returned and have also said that the money is gone.
I have searched the internet for hours and cant find anything. I called legal
aide and they were of no help. I have no idea what to do and have no idea if
there is anything that will protect us.
