Legal Question in Landlord & Tenant Law in New York

Ex Landlord claims abandonment of trailer....Do Not own it

My ex landlord is claiming I abandoned a trailer in his lot and I owe him back rent and wants me to remove the trailer, by Nov 1st. I do not own this trailer. My name is NOT on the title. It HAS been abandoned in the past and HE 'without title' SOLD it to a woman almost five years ago, she moved out, and I signed a one year lease (which he never gave me a copy of) and I moved in. I lived there a little over two years, and decided to move out. I called him to let him know and told him I even had two people who both wanted to move in. He denied both, got my number from one of them, called me at my new place, and told me I had to remove ''my'' trailer from his lot. I told him it wasn't mine trailer and I hung up. Four months have gone by since then. He lost ''my'' number and decided it would be nice to track down my sister and bug her and my niece (one of the people he denied) for my number. Neither gave it to him and he continued to call and bug them. At one time he had told them he was selling it. And then decided to call upon a lawyer to 'serve' me with a letter at work, telling me I have two weeks to pay and remove trailer, or he 'may' take me to court. What should I do?

Re: Ex Landlord claims abandonment of trailer....Do Not own it

If the landlord brings an action against you in Landlord/Tenant court you must appear by filing an answer to his petition. This will prevent him from getting a default judgment against you and it will give you an opportunity to prove your case.

Were you served with a "notice" and a "Petition" demanding you to appear in court? If so, you need to serve an answer and file it in court. This should be in the Landlord/Tenant division of the Civil Court in the county where the trailor sits.

I advise you to retain an attorney to help yiu through the process. Feel free to call me at 516 256-7737
