Legal Question in Landlord & Tenant Law in New York
My landlord has been demanding cash as payment, but refuses to give a receipt. We notified him we would be moving out. He served us with eviction papers which states we owe 4 months rent. Since I can not prove I have paid, can the town judge orderme to pay thatamount or will it be moved to a claims court?

The Judge may order you to pay the amount.
Did you have any witnesses to the transaction? Do you have statements demonstrating where you received the cash? An answer of yes to the prior two questions may help you demonstrate that cash payments were given to the landlord.
