Legal Question in Landlord & Tenant Law in New York

Landlord issues

I have a month to month agreement with my couple who's basement am renting, my rent includes utilities, cable internet laundry and use of the backyard. Last month I was not allowed to do laundry causing me to use the laundromat, I paid the rent less $100.00 because it cost me about that much including tranportation since I don't drive. They are refusing to accept the rent less my expenses and adding another $100.00 to my rent because times are hard. Can I please get some advise regarding legal ways of dealing with this? They enter my apartment whenever they please which I can prove, plus the wife admits to being in there since it is her house. Please advise me on how to deal with this problem, thanks

Re: Landlord issues

I don't know of any legal basement apartments in Suffolk County. Therefore, I would venture a guess that the apartment you are in is illegal.

If illegal, you have the right to leave the apartment without consequence. A court will not uphold an illegal agreement. Even if you stop paying rent and wait for the eviction, if illegal the court will not require payment on your behalf to the landlord.
