Legal Question in Landlord & Tenant Law in New York

landlord sold house

I have been living in s three family house for 5 years. I got a call from my landlord's daughter. The landlord is living in a nursing home now. She said they sold the house and I had to be gone in 30 days. This is not possible. I cant find a place in that amount of time. I would need around three months to get a new place. what are my rights?

First, do not panic. There must be a court order to evict you and you will get a chance to defend the action.

1. They must first give you a 'notice of eviction'. Since this landlord has sold the building, the new owner is the one who must give the notice.

2. The new owner bought the building with your lease intact. You are the tenant of the new owner under the terms (rent amount, etc) from the old lease.

3. The lease ends on the same date it did before.

If they do try to evict you, I recommend defending with a lawyer.

You are welcome to a consultation for no fee.

Re: landlord sold house

Your rights are spelled out in your lease, assuming you have one. That's the first place to check. If you don't have a lease then, by law, you are a month-to-month tenant and your landlord is only required to give you 30 days notice.

Re: landlord sold house

If you have a lease, you cannot be evicted before the lease terminates. If you have no lease you must be given at least 30-days notice prior to the start of the next rental period and the 90-day notice you were provided would be legally sufficient.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
