if mylandlord wants to evict me based on the guidelines of an old lease an i am on a month to month and he claims i threatend him an actually got an order of protection against me can he evict me if he served me inappropiately an the judge granted a hearing what can i do

There is not really much you can do. He has the right to evict you as long as he gives you one month notice. In New York City, there is a specific way to give that notice but in other parts of New York the courts allow almost anything to constitute notice. My advice is to go to court and plead your case to the best of your ability. The beauty about pleading your case is that even if you lose the judge will give you another 30 days to leave your house/apartment.
