Legal Question in Landlord & Tenant Law in New York
Late fee
I am Landlord,I evict Tenant because she has failed pay rent. In agreement is late fee for non payment, ($10 a day) I have Justice Court tomorrow. Do I have right get late fee?

Re: Late fee
Not $10 a day. Pursuant to law that fee would be deemed a penalty and not enforceable. An enforceable late fee is 5%.
