Law Suit against my landlord

I live in an apt in manhattan. My apt. has many problems. We have mice, we never have hot water, the shower doesnt drain, the fire escape windows do not lock, the outlets dont work, and much much more. The landlord has consistently failed to take care of these problems. We have been living here for 4 months now. Every time the super comes up, he says he will come up tommorow and fix it, but then we never see him again. I have been paying rent of $950 every month and would like to sue the landlord for my rent back. We are moving but i would like that money back since i dont believe i recieved anything for that money. I was wondering if i have the grounds for such a law suit? If someone could please let me know that would be great.thank you

You have a lawsuit for 'constructive eviction' and for breach of 'warranty of habitability'. These two legal doctrines address the very same issues you list.

The good thing about landlords is that; when you sue and win, you can get them to pay!
