lease breach

please help...

in 1994 my family (wife and 2 children) and i moved out 6 months before lease end. the ceiling felt down twice, injuring my wife - she was taken to the hospital. since we moved out we were sued by real estate management. somehow i missed a letter from management lower in february so now i have to pay over $3,000 for lease breach.

please advise

I'm not sure if you're saying they've sent you a claim letter or a judgment. If its a claim letter let them sue, if tis a judgment oyu need to get the judgment re-opened.

This is a difficult situation, but you will be able to deal with this constructively.

I assume the letter (from a 1994 lease today in 2003) states that a judgment has been granted. Since it was a default judgment, this is not a problem. A motion to 'vacate' the judgment followed by your defense backed up by the hospital records will win the case for you.
