Legal Question in Landlord & Tenant Law in New York

Leases and Age

My question is, if I signed a lease for an apartment when I was 17 years old, is that of legal age to enter a lease contract, and is that lease a legally binding contract, though i was under the age of 18 when it was signed?

Re: Leases and Age

It was not enforceable as to you when you signed it (at 17 years old) but upon turning 18 if you were still living in the apartment, the contract was ratfied and became enforceable.

Re: Leases and Age

The General rule is that contracts with minors are voidable by the minor. To do so, the minor must communicate his/her decision to void the contract within a reasonable time after reaching the age of majority. The exception to this rule are contracts for nescessaries such as food, clothing medical care and shelter. So the short answer is you cannot void a lease that you entered while a minor since the lease is a binding contract for necessaries.
