Legal Question in Landlord & Tenant Law in New York
I live in New York and my landlord is trying to evict me. I was given a 3 day notice on February 24 and today on February 26 I was given a notice of petition for non payment, which was before my 3 day notice expires. I also noticed my landlord filed for a court date and dated the notice of petition on the same day I was given my 3 day notice. From what I understand, she is not allowed to file a petition until after my 3 day notice expired if I don't pay or move. What she's done is not legal procedure and I would like to know what to do. I also will not be living in her place at the time of court

You could defeat the eviction, but why pay a lawyer to fight if you're moving out already?
