Legal Question in Landlord & Tenant Law in New York
I have been living with a man for over 20 years. I live in New York. He has become mentally abusive, refuses to work, only gives me minimal amount of money and is very secretive as to where his money (disability) goes. I asked him numerous times to leave. He refuses. What are my rights? The house is in my name only.

I assume that you are not married. Therefore, you would start an eviction proceeding. You would serve a 30 day notice, refuse any future money offered by the man, and then file and serve a notice of petition and petition for holdover proceeding to obtain a judgment of possession and warrant of eviction.

Has he ever paid rent? It seems as if you have a situation where you would need to serve a Notice and then file an action in Housing Court for his eviction. As New York State law is very specific as to the exact wording required in these Notices and the manner in which they must be served upon the tenant, it is highly advisable to retain the services of an attorney experienced in these areas. A small mistake can set you back months in the process. We have handled many such cases, however, we would need some more information before making a complete and proper determination.
