Legal Question in Landlord & Tenant Law in New York
We manage a building that is being sold by the owners. There are tenants living there now that do not want to leave (new owners want to occupy the apartment these folks are living in). This might be a deal breaker if we cannot get these tenants out. Unfortunately there is no clause in their current lease stating we have 30 days notice to get them out of the building. What are our legal rights? Does the law allow us to give notice at this point in writing?

The tenants have the right to possession under the terms of the lease. You would have to wait until the lease expires before obtaining possession of the apartment. On the other hand, the tenants may consent to a modification of lease for the right incentive (money, new apartment, etc.).
