Legal Question in Landlord & Tenant Law in New York

I had given the management company a bank check with my name on it for security and housing fees for my deceased dad. I had also signed a "guarantor" document indicating I would be responsible for rent etc.

I had requested the return of the security deposit and the management company made the check out to the estate of m dad. Since I was the one that paid the security fees and housing fees can they make the check in my name? I have proof that the funds were drawn on my account as the bank check had my name on it.

I think the management company acted appropriately. The lease was in your dad's name. Therefore all money would go to dad - or in your case - the dad's estate.

Of course, you could ask for a new check in your name. However, the management company would have no obligation to comply with your request.
