Legal Question in Landlord & Tenant Law in New York
management company refuses sublease renewal after written notification to renew
I am currently subletting my co-op to a wonderful tenant. Her lease term is due to expire on Oct 31, 2005. I received an email from the sublet coordinator of the management company on July 11, 2005 which indicated clearly that I have ''an additional'' year remaining to sublet my apartment which will also be the final year, and that a lease renewal reminder will be sent to me sometime in August. I received the lease renewal reminder dated August 25, 2005, and I followed the instructions provided which was to furnish them with a new signed contract, letter to the board, fees, etc. The new lease was signed on Sept 13, 2005 after I got the instructions from the sublet coordinator. I put together the package with all the requirements needed for the renewal, and I sent it to management co. for processing. I then received a phone call from another agent of the management co. telling me that I've exhausted my sublet allowance and that my tenant would have to move out by Oct 31, 2005. I explained to her about the email and the letter that followed which clearly stated that I have one more year left and that I've already signed a new lease agreement with my tenant. She said it was a mistake on the part of the sublet coordinator...

This is not unusual.
Do you have the email telling you that you had a year remaining? If so, then you will be ok.
