Legal Question in Landlord & Tenant Law in New York

Misled Subletter

If I sublet, can I be compensated since I found out I have been overcharged $165/month for two years. How long do I have until after the term of my lease to vacate since I was given misinformation about the term of my sublet and payment when I moved in? Am I entitled to a copy of primary tenants lease? I paid $2000 brokers fee for this apt, renewed my one yr lease, and term is up 10/31. I have been there two years and was told I could renew every year for as long as I needed by my broker.

Re: Misled Subletter

Yes you can. There are laws that govern the amount a primary renter can charge a sublessor. The proper remedy is to bring an action in Civil Court, Housing Part. This is not a complicated action.

Regarding the renewals, if the primary renter's lease becomes ineffective (he chooses not to renew), then you lose your lease as well.
