Legal Question in Landlord & Tenant Law in New York

I moved in to this apartment & my daughter been getting bit every since i payed it no attention because she was the only one . And then i notice bed bugs in her room & sometimes they pop up on my matress. I have a grandchild thats 1 month old & 1 was in his bed. I ask the people who live up stairs from me do they have bugs & the man showed me his bites & told me thats why the people who use to live here moved out. I reported my situation to the landlord he sent a person to exterminate but i guess the prices was to high so he sent another one & that man seen roches in the cracks of my daughter wall , the bed bugs & also where the doorbell sound comes out of he notice that was full of roaches. If he dosent do anything a.s.a.p can i sue? Also he gave me bombs but the bombs just brung out the bugs more.

You first MUST give written notice to the landlord. If the landlord does nothing, you may withhold rent since there is a violation of his warranty of habitability - until such time that the landlord cures the problem. If the landlord still does not cure the problem - and after additional written notice - you may break the lease and leave.

I would also suggest you contact the local board of health.
