Legal Question in Landlord & Tenant Law in New York
We moved out of our apt. last month.We completed a final walk thru inspection and was told that we would receive the entire deposit back. I received the deposit check and tried to cash it, only to have the check bounce because they place a stop payment on it. They are now saying we owe them for new carpet. I have the move-out paper saying we owe nothing and the "bad check." I also have the bill from the carpet company with a different prce than we are charged. DO we have a case? Can we sue for the bank fees that our account has incurred because of their bad check?

The intentional giving a bad check is a misdemeanor. Threaten to take the landlord to the District Attorney if the landlord does not make good on the check.
