Legal Question in Landlord & Tenant Law in New York
NY Statute of Limitations
Does the statute of limitations clock
start when the alleged offense
occured or when discovered? This is
a nonpayment of rent issue with a
verbal lease that started in 2002. Is
there anything that says a landlord
should have known within a certain
time period and can't go back for
missing rent beyond a certain time
frame?
Also...if additional info is needed, how
does one edit a question or post?
Thank you...

Re: NY Statute of Limitations
For a breach of contract (even an oral lease), statute of limitations period starts on the date of the breach (not the date the contract was entered into by the parties).
