Legal Question in Landlord & Tenant Law in New York
I am renting an apartment and I live with my landlord. There is no lease agreement. I am helping a friend by letting him stay here for a little bit till he gets on his feet. There was a problem and I want him out now. Can I put him out?
1 Answer from Attorneys
You can, but how you can legally do it depends on his exact status under law. Has he paid rent? How long has he been in the apartment? As New York State law is very specific as to the exact wording required in these Notices and the manner in which they must be served upon the tenant, it is highly advisable to retain the services of an attorney experienced in these areas. A small mistake can set you back months in the process. We have substantial experience handling these types of cases, however, we would need some more information before making a complete and proper determination.
