Legal Question in Landlord & Tenant Law in New York
Return of Security Deposit
Upon renting second floor of two family house,a verbal agreement was made. Landlords said they would not be selling home for 5 yrs., and we were to give them 3 mos.notice if we were to leave. 2 years later,a sign appears in the window that the house is for sale. Told that it was just a ''fact finding expedition''..people traipsing in and out of our home..the house is definitely for sale.Landlords purchased a new home and said they were ''selling us'' with the house. Found a new place through a friend of a friend. Gave landlords 3 weeks notice. Did walk through with landlords. I agreed to pay for paint, and a few other minor repairs. Both tenant and landlord signed aggrement attesting to this fact. Recieved a leter from landlord stating he will not be refunding my deposit and will be charging me an additional $300 (for paint) and if I don't pay that will charge me an additional $700 for labor. I also had given $300 last summer to upgrade wiring..Rent was always paid in cash at landlords request and there was no lease. Can he get away with this?
