Legal Question in Landlord & Tenant Law in New York

Roommate is ripping me off

I moved in with a roommate whom since I entered the

place has been very hostile and plain mean. The rent is

$700 a month and I also gave a $700 deposit. I decided

to move out approximately one month after I moved in

and gave only 2 weeks. She is saying that she can

keep my security deposit, when I never signed a lease.

Do I have a case to take her to small claims court?

Re: Roommate is ripping me off

Probably not. What you entered into was a month to month relationship, which means that you would have to give a months notice before quitting the apartment. You're notice would likely be found to have been inadequate.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.
