Legal Question in Landlord & Tenant Law in New York
security deposit from landlord
Can my landlord keep my security deposit to paint? No where in my lease did it state that I could not paint; nor did it state that I had to paint it to the landlord color preferance when I left. Also, Landlord has not returned my phone calls; nor has her attorney. Landlord refused to do a walk through with me.

Re: security deposit from landlord
The security deposit is for damage to the property, where and tear excepted. If you wrote on the walls, or caused issues with the walls, the landlord would be allowed to use the security deposit to paint the apartment.
If you left the apartment in good shape but the landlord just wants to paint the walls for the new tenant, you would be entitled to the return of your security deposit.
