Legal Question in Landlord & Tenant Law in New York

i am a shareholder in a coop and my right to a quiet, peaceful domicile are not being protected, as the renters above me have no carpeting and constantly wake me up early in the morning, prevent me from concentrating on anything, and make naps and going to sleep when i wish to, impossible. the coop is doing nothing to enforce the 80%-carpeting rule, in the renters' case, and i strongly suspect that $$$$$$ is involved. this has been going on for a year, with neither the board of trustees nor the management co. doing what they should to see that the bylaws (and state laws, i believe,) are enforced. can i set up an escrow (however you spell it) account into which i can deposit my monthly maintenance payments, without engaging the services of a lawyer, in order to force them to do what they're supposed to do?

No. If you're not willing to pay for a lawyer to help you intervene with management, you are better off moving. When the management eventually gets their lawyers involved, what are you going to do then? You'll have to get a lawyer anyway.
