Legal Question in Landlord & Tenant Law in New York

Slip and Fall

The toilet bowl in my basement apartment has been leaking water since the landlord fixed it. I told him about it several times and now I had an accident. The extent of the injury requires surgery to my knee. I have lived the past year with NO lease and the apartment might be illeagl. Can I sue him?
