Legal Question in Landlord & Tenant Law in New York

My son and daughter-in-law signed a year lease and gave equal to 1st month's rent, to rent an apartment in Orange County, NY. They have not received: the signed copy of the lease agrement, the keys, and are supposed to move in by November 15th. A change of circumstances has comeup and they cannot move into the new apartment. They told the rental agent and the rep said they will sue them for the full year of rent. Can this be? It is a brand new apartment complex- unit has never been rented before.

While anyone can sue for anything, since they never received the signed contract back, I see no completed agreement. In addition, the landlord must make efforts to mitigate damages(rerent).
