Can I start a non payment petition in housing court if the tenant owes more than 7 months of rent and if so what form is required?

You file a petition and notice of petition. Rent more than 6 months past due may be ruled "stale," but that would not prevent a judgment of possession for the most recent six months. You would have a money judgment for the stale rent.
