Legal Question in Landlord & Tenant Law in New York

Subleaser deposits my deposit

I subleased an apartment in NYC and paid 3 months worth of rent upfront with an actual written agreement. When it was time for me to pick up the keys this person emails me stating that the sublease is not going to work and that he wasn't going to return my check (i.e. deposit). Although I had a signed agreement with this person do I have any legal recourse. In addition he states in his email that he is now in Florida rather than NYC and he has changed his cell phone number.

What, if any, are my options?

Re: Subleaser deposits my deposit

You need to find him in Florida and begin a lawsuit.

You can also sue him at his 'last known address' or 'last known place of business'. This can be done in small claims court. Get a judgment, and then a credit collection agency can help you.

Good luck.
