Legal Question in Landlord & Tenant Law in New York

My parents own a home. They had tenants that lived up in the second floor. When they moved out they left the place a total mess, they left garbage (I mean garbage bags full of garbage to be taken out with the trash), they left everything they didn't want all over the floor. The place is a total mess, and I have pictures. Now the tenants are family, well estranged family members. Do my parents have a case that can be brought against my ex-brother-in-law. Also, the movers had to take the door off it's hinges to take the furniture out and nobody put the door back on the hinges.

From the facts that you've prsented it cetainly seems that your parents have a case. If they still retain a security deposit they may be able to retain some or all of those funds if not they would have the right to initiate legal action...�..this area of law does happen to be one of our specialties, however, we would need some more information before making a complete and proper determination. Yes, they either have a claim for the damage and clean up or they can deduct it from the security deposit.
