Legal Question in Landlord & Tenant Law in New York

Being sued by my landlord!

We recently got sued by our landlord who claims we owe him for the last two months rent, april and may. However, when we signed our lease we agreed that before we move in we will pay him the last months rent AND one months security. So, the last months rent was paid for at the beginning of the lease. There is five of us in the house and 2 of the guys paid the rent for april and the other 3 did not. On our lease it states that the tenant will pay the last 2 months rent and one months security, the security will be returned at the end of the year. Now, we are being sued for april and may when in fact we payed him for may and we payed him for half of april. Plus he still has our security deposit. We have pictures from before we moved in and when we moved out, which was friday. What else should we do, doesn't this just mean that we owe him for april and he owes us our security deposit??? He also wants late charges for both april and may. We never received any notices that claimed we were late on any payments until we received the eviction notice...we are looking for a lawyer...thanks for your time!

This is a very uncomfortable situation the landlord has put you into. I assume this is small property owner and not a large corporation.

This kind of foolish larceny is unfortunately very common here in NYC (and elsewhere).
