Legal Question in Landlord & Tenant Law in New York
tenant don't want to leave
last july we found out that the heat/hot water was illegally tapped on the 1st floor, we told our tenant in the basement that they have to move the next month (august) so we can fix the problem. They agreed, unfortunately as of this time (october) thay are still there and they have not paid a single penny. what can we do? please help. thanks

You would have to start a summary proceeding for eviction. Depending on circumstance, you would have to start either a non-payment proceeding or a holdover proceeding. The eviction process may be technical so it is best to retain an attorney.
