Tenant likes to over flow toilet

My tenant over flows his toilet at times. I live in the same

building. Can I use his security to pay for my damages. If I can't, what can I do or should I ask '' What is the correct

legal way to make him pay for damages ?.''

ps I checked the toilet - nothing wrong.

I changed the toilet - nothing wrong.

I had a plumper come - nothing wrong.

The specific purpose of the security deposit is to pay for damages not caused by normal wear and tear but you better be sure that there is nothing wrong with the toilet before you start deducting.
