Tenant never pays rent on time or all of it. Does not read the lease and what she has signed. we would like them to leave. what is the first procedure.

You would have to follow the procedure in the lease for the nonpayment of rent.

Generally you need to start with having a proper 5 Day Notice for Rent Demand served on the Tenant. As New York State law is very specific as to the exact wording required in these Notices and the manner in which they must be served upon the tenant, it is highly advisable to retain the services of an attorney experienced in these areas.
