my tenant refuse to pay this month rent and will continue to do so until he find another place to move out. what should I do now? He claimed I provide not enough heat, but I set the temperature exceed the law require. He just use this excuse to attack me. He is paying $800 and security deposit has only $700. Please advise me what to do now?

You will need to initiate summary proceedings for his eviction. NYS statutes are very specific with how a tenant must recieve notice of a summary proceeing and how it must be filed. These procedural technicalities must be followed very carefully or can result in extensive delays and dismissal of your action. As such, it is highly advisable to retain an attorney to initiate such an action.
