Legal Question in Landlord & Tenant Law in New York
Witnesses
In a small claims court case a credible witness will not be able to attend the hearing as he lives too far away in another state. How could we get his testimony entered otherwise?
The witness sent a notorized, certified, unopened letter to be entered into evidence. The letter was not accepted by the judge on the grounds that the witness was not availbale for cross examination.
Would appreciate any other suggestions.
The case was reversed once by an appeals court and is going back to trial in a few weeks. This testimony is crucial to our case.

Re: Witnesses
You can't. The witness must testify in person.
