Legal Question in Legal Ethics in New York

ON 8-25-2007 I received a letter from a law firm representing NYSEG claiming I owed NYSEG $3800. I called the law firm, I also called NYSEG and emailed NYSEG - neither would give me any information regarding this. On 10-6-2007 I was served a summons which I now must deal with or a judgment will be entered by default. Until yesterday I had no idea that they were after my 33 year old son for destroying a pole with his vehicle. All the exhibits clearly show they have the wrong person, yet they have refused from day 1 to correct this situation.
I have to go to my county's superior court clerk and hope they can stop this or demand a court date and spend even more time on an issue that does not involve me.
I am hoping the law allows me to be compensated for both their actions and lack of appropriate fact finding.

Sure, keep good records and you can sue them later for abuse of process.
