Answer and Counterclaim
Hi.
I was wondering whether in New York, does a answer and counterclaim need to be filled with the court prior to serving it upon the plaintiff in the action???

No. Serve answer counterclaim, attached affidavit of service on pleadings, file pleadings with Clerk.
