Legal Question in Legal Ethics in New York
We are creating an online business where we will be raising money for charities. Our company is NOT a charity, but we will be raising money FOR charities. (We accept a fee for each donation, and collect money from online advertising).
First question: Is there any paperwork we need to file with the state since we are collecting funds on behalf of charities? Except for our fee (which is added on, in addition to the donation), we will NOT be using the money for anything else. The money is held for a short period of time (while the user tries to collect more money, and build a collection of donations). Once the goal time is up, the money is all sent to the charity.
Do we need to get the charity's permissions, or can we just say to the user "choose a charity from our list of charities"?

A. Yes. I would look at the NYS Attorney General's website.
