retainers

I have a client that loaned his daughter $3000 for a divorce. The attorney handling the divorce put it in his trust account as a retainer. However, the daughter died without an estate. Shouldn't the attorney return the retainer to my client?

The attorney should return the $3,000 to the estate less attorney fees and disbursements generated against the retainer.
