Legal Question in Legal Malpractice in New York
We hire a lawyer to help sell our house. When we sold the house the buyer wrote the check to the lawyer . And gave my family a deadline of 30 day to move out the house. The lawyer Cash the check and spend it for hes own purpose , it been two weeks now since we sold the house and we have not receive any money from the lawyer. Now our deadline is running out. My question is Since we never actually got paid for the house do the agreement still stand,? And can I sue the lawyer.?

Did you contact your lawyer and inquire about the money? He has to explain to you in writing, if you demand an explanation. Contact him by phone and ask where the money is? If you have not been contacted, you should proceed to the District Attorney's office and make a formal compaint for conversion of property ( a felony ). Contact your local Bar Association and seek their help; they will direct you. If you require additional help, you may contact me, but better to take the first two steps I indicated above.
