Legal Question in Legal Malpractice in New York
My lawyer's conduct and errors at hearing
I was fired without ''cause'' from the firm I founded 40 years ago. This was when the company had gone private after being public for some time. It was my responsibility to draw up the ''going private'' employment contracts and operating agreement for the new private LLC. I assigned an employee to be the go-between between myself and the attorneys. I did not know it, but all of my partners were involved with the go-between person and they all knew that the contracts were not being written as I had said. Rather, without my knowledge, they were writing the contracts with a lawyer on the side who was helping them write contracts in which they could fire me without ''cause and immediately be granted my 40.5% of membership shares. They fired me and wanted the stock. I went to arbitration. My lawyer refused to listen to anything I said, came up with two flimsy reasons for why I could not be fired without ''cause,'' was abusive to me throughout our prep time, refused to tell me what issues he was arguing. Did not call one witness to defend me, did not have a shred of evidence that I was not the way they were portraying me, and did not do any cross-examination on important issues. After hearings, he swore we had won. We lost terribly
