What is the statute of limitations for filing a legal malpractice in ny in a divorce case?. Is it from the time you hire the attorney or after the divorce has been signed.

The statute runs from the time of the malpractice - either the date of occurrence or the date on which you knew or should have known of the malpractice. What the date of occurrence is is dependent upon the specifics of the incident.

The statute of limitations as to a legal malpractice matter does not, in the divorce context, begin to run until "the day the judgment incorporating the stipulation was filed in the county clerk’s office."
