Legal Question in Legal Malpractice in New York
NY Judiciary Law Section 487 has both civil and criminal elements. Is the evidentiary rule used for it preponderance of evidence or beyond reasonable doubt?

Preponderance.
The Penal law covers any misdemeanor, and that piece is under "beyond a reasonable doubt."
