Legal Question in Legal Malpractice in New York
question
I previously had--name removed--car accident, no fault of my own. I used an attorney who referred me to--name removed--medical center for treatment of my injuries. When my case was up, even though I have 5 bulging disks and--name removed--pinched nerve, I was told I would not received much for my injuries because the doctor I was seeing was being sued for medicaid fraud. They settled my case for almost nothing. What should I do? Is this malpractice? Did they just want to get rid of me to get rid of their connection to this doctor?

Re: question
Your question can't be answered fully on the basis of the facts you submitted.
There are several factors that have to be considered:
1. What is the "value" of your injuries - what are comparable awards for those injuries.
2. Who was being sued, and what, if any, assets did they have.
3. What evidence was available to support your claim that your injuries were caused by the negligence of the party you were suing.
Without knowing the answers to those question, as well as whether there was an improper or undisclosed relatinship between the attorney involved and the doctor, it's impossible to give you a more precise response.
