appendicitis, Doctors waited until they burst
I have a friend, In New York
Her Grandbaby age 10, went into a Watertown New York Hospital sick and in pain. Doctors did nothing and could not find what was wrong with him.
Sent him to Syracuse Hospital, They found his appendix had burst.
I Think this should have been caught in the Watertown hospital. We Just don't go in a hospitla now and have our appendix burst?
Does My friend have a lawsuit?

It would be imposssible for anyone to speculate about whether your friend has a lawsuit, based on a second or third-hand opinion of the out-of-state friend of the grandparent. If your friend believes there may be an issue, she (actually, the parent) needs to speak with a local attorney, who will discuss the need for independent medical opinions.

There may be a claim but it depends on what happend. If the first hospital failed to diagnos appendicits, there could indeed be a case. If the appendix was already burst when he got to the first hospital, there is no case pursuing because of the costs of pursuing a medical malpractice case and the limited damages. In order to pursue a case, the child and family needs to meet with a medical malpractice attorney who will get the records and have them reviewed by a doctor. In New York, a medical malpractice case cannot be started unless a doctor certifies there has been negligence. My office handles these cases and I would be happy to discuss the matter further,
