Legal Question in Medical Malpractice in New York
need attorney
Had an attorney for two years. He now withdraws. How hard is it to get another. Court has allowed me to find new counsel and they can take over where old lawyer left off. My son was injured in an accident. He was operated on but contracted the MRSA and passed three weeks later.

Getting a new attorney after an attorney has already worked on the case for so long can be difficult. The real question is where does the case currently stand and is the case worth pursuing. The answer to the question of whether it is worth pursuing is not based upon emotions or your terrible loss but what can reasonably be expected to result from the lawsuit as it currently stands. Many factors can cause an attorney to leave a case. Its easy to find an attorney - friends, phone book, law guru are just some examples. The issue is will an attorney take your case. This depends on why the prior attorney got off the case. It could be the attorney sees no case or it could be you were not getting along with each other. My firm has a large negligene department and I would be happy to discuss your situation with you.
