Legal Question in Medical Malpractice in New York

do I have a case if this happens?

I'm 28 yrs old and having alot of pain for no reason that I can think of. I've never had any serious injury to any part of my body other then a cut on my big toe on my left foot. That happen at the age of 12. My mother was diagnose with fibromyalgia syndrome at the age of 28. I have been going to the doctor numeros time about pain thought my body for no reason. I've decided to switch dr. to get a doctor who will listen to my troubles and try to help me because someday the pain is really bad on a scale of 1-10 its a 9. If this new dr. fines a problem or diagnose my with the same syndrome as my mother would I have a case for malpractice.

There would be case only if the first doctor's failed to diagnose you when he should have and that failure prevented a cure or made your condition worse.
