Legal Question in Medical Malpractice in New York

C-section gone really wrong?

I was 36 wks pregnant when I went to the hospital because my water broke by morning I wasn't in labor and Dr said that because I had a previous C-section they don't like to induce labor and suggested a C-section. That is when my nightmare began, instead of feeling only pressure I felt lots of pain aparently the epideral didn't work as planed, but before they began they pinched me and ask if I felt it and I said yes, don't know why they continued, during the screaming one of the Residents fainted which was very scary. A few days later I complained about a horrible pain and they it was gas and it would go away in a few days, a few days later it was worst, they did and X-ray and still said that it was just gas, they gave about 4 enemas within a day, sent me home the next day. A few hours later I was rushed to the ER because the pain came back. They did another X-ray and still said that it was gas, the Dr gave one more enema that did not work. Sometime during the morning, this was 5 days after C-section the Dr involved a Surgeon that immediately schedule an emergency operation. The Dr that did the C-section perforated my colon. I ended up with a Colostomy and have to go back for a 3rd surgery.

Re: C-section gone really wrong?

I'm sorry to hear about what happend to you. You may have a case. In New York, a doctor must certify that there is a valid case of malpractice before the attorney can commence the lawsuit. Therefore, my office would obtain and review your medical records and then have an ob/gyn review them to give an expert opinion. The real issue is whether perforating the colon is an expected and acceptable risk of a c-section. We handle these cases on a contigency basis and would be pleased to discuss your case with you if you would like. I can be reached at 212-622-7180. Good luck.

Re: C-section gone really wrong?

While it is difficult to evalulate any case from the bare minimums that are posted in this forum, it is possible that you may have a case in medical malpractice against the doctor and/or hospital where the C-Section occured. Whether there is a case can only be decided after a doctor has reviewed your records. My office would be happy to discuss with you. Please call or contact us via e-mail at your earliest convenience.
