Legal Question in Medical Malpractice in New York

Hello...I live in NY, NY and I had a PRK (eye lasik) a year ago. this year I requested my medical records released and its been several months and they still haven't provided me with these records every time I call I get all kinds of excuses as to why they can't get me my records either (the Dr is in surgery, or an emergency arise, or its under lock in key and only he can authorize the release) what can I do at this point in time to get access to my medial records.
